UK Mortgage Academy – CeMAP® Course Terms & Conditions

Effective Date: 1 January 2024
These Terms and Conditions (“Terms”) govern your participation in the Certificate in Mortgage Advice and Practice (CeMAP®) course provided by UK Mortgage Academy, a subsidiary of Britain Connect Group. By enrolling in this course, you agree to abide by the following Terms, which are intended to protect both the Learner and the Institution, and clarify our mutual rights and responsibilities.

1. Definitions and Interpretation

1.1 In these Terms and Conditions:

  • “Academy” refers to UK Mortgage Academy and its affiliated operations.
  • “Learner” refers to the individual enrolling in the CeMAP® course.
  • “Course” means the Certificate in Mortgage Advice and Practice (CeMAP®) training programme delivered by the Academy.
  • “LIBF” means the London Institute of Banking & Finance, the awarding body of
    CeMAP®.

1.2 Headings are inserted for convenience only and shall not affect the interpretation of these Terms.

2. Course Enrolment and Payment Terms

2.1 Reservation Fee: A non-refundable reservation fee is payable to reserve a place in the Course. The reservation fee forms part of the overall course fee.
2.2 Total Course Fees: The full balance must be paid prior to gaining access to course content.
Payment plans may be offered in specific instances and must be agreed to in writing.
2.3 Accepted Payment Methods: Payments must be made via the methods set out on the Academy’s website. The Learner is responsible for any charges imposed by their bank or payment processor.
2.4 Tax and Duties: The Learner is responsible for all applicable taxes and duties arising in Hong Kong or any other jurisdiction from their enrolment.
2.5 Invoices and Receipts: An invoice will be issued upon request. Receipt of payment serves as confirmation of enrolment.
2.6 Non-Transferable Enrolment: Course enrolment is strictly personal and non-transferable.
Access credentials must not be shared.

3. Course Delivery and Platform Use

3.1 Mode of Delivery: The Course is delivered entirely online through a dedicated e-learning platform with video modules, readings, quizzes, mock exams, and tutor support.
3.2 Access Duration: Access is granted for 6 months from the date of full payment. Extensions may be requested and are granted solely at the discretion of the Academy.
3.3 Technical Requirements: The Learner must ensure they have stable internet and a compatible device. The Academy is not liable for access issues due to technological limitations on the part of the Learner.
3.4 Platform Maintenance: Scheduled and unscheduled maintenance may occur. The Academy will endeavour to notify users of interruptions where possible.
3.5 Support Availability: Tutor and technical support is available during Hong Kong working hours. Queries will be addressed within a reasonable time.

4. Examination Responsibility and Limitations

4.1 External Examination Provider: The CeMAP® examination is administered by the LIBF and not by UK Mortgage Academy.
4.2 Booking and Fees: The Learner is solely responsible for registering and paying for the examination through LIBF.
4.3 No Outcome Guarantee: Completion of the Course does not guarantee exam success. Exam performance depends on the Learner’s efforts and capabilities.
4.4 No Academy Certification: Certificates are issued only by LIBF. The Academy does not confer any qualifications.
4.5 Re-attempting the Course: Access to the Course after initial expiry requires re-enrolment and payment of applicable fees.

5. Employment Disclaimer

5.1 No Employment Offer or Guarantee: The Academy makes no promise, guarantee, or offer of employment, job placement, or internship upon completion of the Course.
5.2 No Inducement: The Learner acknowledges that they have not been induced to enrol based on any verbal or written representations concerning future employment.
5.3 Marketing Disclaimers: Testimonials, success stories, or promotional content are not to be construed as indicative or predictive of employment outcomes.
5.4 Unauthorised Communications: Any statements by third parties, agents, affiliates, or instructors about employment prospects are unauthorised and not binding on the Academy.
5.5 No Affiliation with Employers: While the Academy may highlight industry trends or
potential career paths, it is not affiliated with any employer offering job opportunities.

6. Refunds and Cancellations

6.1 Non-Refundable Reservation Fee: The reservation fee is non-refundable under any circumstances.
6.2 Cancellation Before Access: Cancellations requested before access to the learning platform may qualify for a partial refund, less the reservation fee.
6.3 No Refund After Access: No refunds are available once the Learner has accessed the course materials.
6.4 Exceptional Cases: Refunds in cases of illness, bereavement, or other exceptional events will be reviewed on a discretionary basis and may require supporting documentation.
6.5 Provider Cancellation: If the Academy cancels the Course for any reason, the Learner will be entitled to a full refund.

7. Intellectual Property Rights

7.1 Copyright and Ownership: All Course content is protected by intellectual property laws and remains the property of the Academy or its licensors.
7.2 Personal Use Licence: Enrolment grants a personal, non-commercial, and limited right to use the Course materials.
7.3 Prohibited Uses: The Learner must not reproduce, distribute, sell, publish, or make available Course content without written permission.
7.4 Termination for Breach: Any misuse of materials may result in termination of access and legal action.

8. Conduct and Compliance

8.1 Code of Conduct: Learners are expected to conduct themselves professionally and respectfully. Harassment, abuse, or threats against staff or other learners are grounds for removal.
8.2 Integrity in Study: The Learner must not engage in plagiarism, impersonation, or academic dishonesty.
8.3 Breach Reporting: Any suspected breach should be reported immediately. The Academy will investigate and take appropriate disciplinary action.
8.4 Termination for Misconduct: Misconduct may result in suspension or permanent exclusion from the Course without refund.

9. Limitation of Liability

9.1 Extent of Liability: To the maximum extent permitted under Hong Kong law, the Academy’s liability for any claim related to the Course shall not exceed the amount paid by the Learner.
9.2 No Indirect Damages: The Academy is not liable for loss of income, business opportunity, or indirect damages.
9.3 Third-party Content: The Academy is not liable for the accuracy or quality of third-party links, tools, or content shared during the Course.
9.4 Force Majeure: The Academy shall not be liable for events beyond its control, including but not limited to acts of God, pandemics, strikes, or internet disruptions.

10. Governing Law and Jurisdiction

10.1 These Terms and any disputes or claims arising out of them shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR).
10.2 The parties irrevocably agree that the courts of Hong Kong shall have exclusive jurisdiction to settle any dispute or claim.

11. Privacy and Data Use

11.1 Data Protection Compliance: The Academy complies with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong.
11.2 Use of Data: Personal data collected will be used only for course administration, communication, support, and legal compliance.
11.3 Third-party Access: Data may be shared with third parties only as required to deliver the Course (e.g., platform providers), under strict confidentiality.
11.4 Marketing Consent: The Learner may opt out of marketing communications at any time.

12. Entire Agreement and Changes

12.1 These Terms represent the entire agreement between the parties and supersede any prior agreements or understandings.
12.2 Any amendment must be in writing and signed or electronically agreed by both parties.
12.3 Continued use of the Course after notification of updated Terms shall constitute acceptance of the revised version.
12.4 If any provision is deemed unenforceable by a court of law, the remainder shall remain in effect.

13. Complimentary Resit Pass Policy

13.1 Eligibility for Complimentary Resit: The Academy recognises that exam outcomes can be challenging and is committed to supporting learners in their success. Therefore, learners who do not pass one or more modules of the CeMAP® examination within one (1) year from the date of
their first sitting on the Academy’s e-class platform may be eligible for a complimentary resit access, subject to seat availability.
13.2 Scope of Complimentary Resit: This resit access includes re-admission to the online course content for the relevant failed module(s), allowing the Learner to review materials and retake internal mock assessments. It does not include additional one-to-one tutoring or LIBF examination rebooking costs.
13.3 Application Process: Eligible Learners must submit a written request to the Academy’s support team along with official documentation of their exam result. Requests must be made within 30 days following receipt of the relevant exam result.
13.4 Limitations and Discretion: Complimentary resit access is granted at the sole discretion of the Academy and may be withdrawn or modified at any time. Learners abusing the policy or misrepresenting exam results may be disqualified from further support.
13.5 No Guarantee of Success: While this complimentary resit support aims to assist in exam preparation, the Academy makes no guarantee of a passing outcome on resit attempts.
13.6 No Cash Value: The complimentary resit access has no cash or refund value and may not be exchanged, sold, or transferred.
